New Delhi, May 10, 2026: The Supreme Court is set to hear on May 11 a Public Interest Litigation (PIL) seeking directions to regulate all institutions imparting secular education and religious instruction to children below the age of 14.
A bench comprising Justices Dipankar Datta and Satish Chandra Sharma is likely to hear the petition filed by advocate Ashwini Kumar Upadhyay through advocate Ashwani Dubey.
The plea urges authorities to “register, recognise, supervise and monitor” all institutions providing secular education and/or religious instruction to children under 14 years, citing Articles 21A, 39(f), 45 and 51-A(k) of the Constitution.
According to the petition, Article 30 does not confer any additional rights or privileges beyond those already guaranteed under Article 19(1)(g). It seeks a declaration clarifying that Article 30 is a reiteration of existing constitutional rights and does not provide special benefits to minorities.
The petitioner argued that children are the “backbone of the nation’s growth” and are vulnerable at a young age, making it the State’s responsibility to ensure proper oversight of institutions imparting education and religious instruction.
The plea also raised concerns over the alleged operation of unregistered and unrecognised institutions in border districts of Uttar Pradesh. Mr Upadhyay claimed such institutions were functioning without effective regulatory oversight.
Describing the matter as an issue of national importance, the petition called for a proper regulatory mechanism to monitor institutions educating children below 14 years of age.
